RESOLUTIONS SPONSORED BY AICEIA SURAT BRANCH DURING XIXth Biennial Convention of AICEIA at Shillong on 24-25th June, 2016

(1) Paperless work system should be introduced in the department. Under new software proposed for GST regime, there should be a facility of cross tally of CENVAT Credit, as there exists for TDS verification in ITD software of Income Tax Department. This will prove to be a great step towards safeguarding of government revenue. Further noting, drafting and file movement in online format will ensure that no officer sits on file and it will also ensure accountability and transparency. – RESOLUTION PASSED.
(2) In another step towards paperless work system. Digital records system should be introduced and all the unnecessary files occupying office accommodation may be preserved in the digital format. The same practice has already been followed in Passport Offices throughout India. Only such legal files, which can not be archived in digital format should be maintained in physical form. – RESOLUTION PASSED.
(3) Benefit of 1% incremental scheme should be given to all the employees of the department by way of Group Health Scheme. – RESOLUTION PASSED.
(4) DGHRD vide its letter dated 09.06.2016 has instructed the zonal authorities that its guidelines should strictly be followed in providing of office and residential accommodations to the officers of the department. However the same are totally deviated. It is therefore proposed to file RTI throughout the country to know in how many cases the DGHRD guidelines have not been followed and accordingly approach the appropriate forum to redress the problem of not following the guidelines with suitable solutions from Association end. – RESOLUTION PASSED.
(5) With the changing circumstances and work conditions of the departmental officers with the proposed introduction of GST era, Uniform will only distinguish the Central GST officers from State GST officers. Accordingly, it is proposed that our demand for abolition of uniform may please be dropped and demand for issue of proper guidelines for wearing of uniform may be raised. – RESOLUTION FAILED BY MAJORITY VOTE.

Representation against Draft Seniority list of Inspectors dated 17.05.2016

Sir,
            Subject : Representation- against the draft Seniority list of Inspectors of Central    Excise and Customs as on 01.01.2014, circulated vide F.No. II/34-01/CCO/2016 dated 17.05.2016 – regarding.

            Kindly refer to letter F.No. II/34-01/CCO/2016 dated 17.05.2016 regarding circulation of draft seniority list of INSPECTORS of Central Excise and Customs as on 01.01.2014 issued by the Addl. Commissioner (CCO), O/o the Chief Commissioner, Vadodara Zone.

2.         In this connection, we would like to bring to your kind notice that, a number of our cadre members have shown their anguish against the draft seniority list and we are compelled to represent against it. Brief facts regarding preparation of this draft seniority list are as under :

(i) A draft Seniority list of Inspectors was circulated vide letter No. II/34-08/CCO/2013 dated 14.10.2014 of CCO Vadodara.

(ii) The aforesaid draft Seniority list of Inspectors circulated vide letter dated 14.10.2014 was finalised vide Final Seniority List issued under letter No. II/34-08/CCO/2013 dated 11.05.2015 with the approval of the Chief Commissioner. Para 3 of the said letter read as under :
“3. With the issuance of this Seniority list, all the representations received against the Draft Seniority List circulated vide this office letter dated 14.10.2014 stand disposed off. However, this Seniority will be subject to the final outcome of OA 405/2014 pending before the Hon’ble CAT Ahmedabad Bench and SCA No. 15790 of 2014 pending before Hon’ble High Court of Gujarat and any other Court case in the similar issue in the territorial jurisdiction of Government of India.”
                       
            Accordingly, no scope was left for review of the aforesaid final seniority list unless a Court of law orders to the contrary or some substantial fresh representation is received.

(iii) A fresh Draft Seniority list has now been issued vide F.No. II/34-01/CCO/2016 dated 17.05.2016, wherein it is clearly mentioned at Para 2 as under :
“The draft seniority list of Inspectors has been prepared on the basis of Hon’ble CAT Ahmedabad’s Bench’s Order dated 15.12.2015 in OA No. 405/2014 filed by Shri Vijay Kumar Makode and Others in accordance with the directives issued by the Apex Court in the case of Shri N.R. Parmar & Others.”

Accordingly, the authority has itself declared that they have not received any fresh representation meanwhile and the changes occurred in the Final Seniority List are owing to the CAT Ahmedabad Orders only.

            (iv) OUR ASSOCIATION, WITHOUT PREJUDICES TO ANY INDIVIDUAL, HAS SUFFICIENT REASONS TO BELIEVE THAT THE DRAFT SENIORITY LIST ISSUED ON 17.05.2016 HAS BEEN DRAFTED BY PRESENTATION OF MISLEADING AND INCORRECT FACTS BY THE LOW LEVEL OFFICIALS BEFORE THE DECISION MAKING AUTHORITIES.

            (v) Being aggrieved with the said draft Seniority list, our Association submits the following representation for positive and sympathetic considerations by your             honour. 

3.         REPRESENTATION :

(i)                 Many Inspectors recruited through SSC Combined Graduate Level Examinations-2006, were wrongly allocated to Vadodara Zone, who were later redirected to some other zones as a result of CAT Cases or by Board level orders. For example Sl. No. 307, 312, 319, 321 etc. Since, these officers were never meant to be allocated to Vadodara Zone, their names should have been replaced with the direct recruit Inspectors correctly allocated to this zone. Such officers were never in the strength of our zone and they are in the Seniority lists of both Vadodara zone and their own zone. Continuing with their names in the seniority list of our zone, places the direct recruits of 2006 batch, far behind his actual position inter se the promotees. Direct recruits will have to suffer badly in their future career prospects, if such anomalies are not removed.
(ii)               Many Inspectors, who were not in the Final Seniority List of Inspectors circulated vide letter No. II/34-08/CCO/2013 dated 11.05.2015 have been inserted out of a sudden in the new draft seniority list. As the new draft seniority list has been prepared on the basis of Hon’ble CAT Ahmedabad’s Bench’s Order dated 15.12.2015 in OA No. 405/2014 filed by Shri Vijay Kumar Makode and Others in accordance with the directives issued by the Apex Court in the case of Shri N.R. Parmar & Others, as mentioned in the forwarding letter, it is shocking and surprising, that a number of new names of direct recruit Inspectors (such as Sl.No. 303, 304 etc.) have been added in the new draft seniority list, moreover when such names are nowhere in the final seniority list dated 11.05.2015 and there are no directions of any Court of law to insert these names in the seniority list and that too has been done without any representation, to the best of our knowledge. The direct recruit will have to suffer badly in their future career prospects, if such anomalies are not removed.

4.         PRAYER : In view of the above facts and representations, it is prayed that :

(i)                 The Draft Seniority list may be revised by deleting names of the direct recruits of 2006 batch, who were wrongly allocated by Board and were later correctly allocated to their parent zone. Their Seniority ranks may be replaced as per DOPT guidelines by correctly allocating to the Direct Recruits of our own zone.

(ii)               The newly inserted names, which were not in the final seniority list dated 11.05.2015, may kindly be deleted.

(iii)             No promotion orders may be issued or DPCs be held on the basis of this factually wrong seniority list, to avoid any litigation or need to provide retrospective effect of corrections, as a result of any new court orders.

(iv)             Any other relief, may kindly be granted.

 Sub: DPC for promotion against vacancies available in the grade of Superintendents of Central Excise and Customs -  reg
    
                It is learnt that DPC for promotion from Inspector cadre to Superintendent cadre is not being held on account of referring the CAT, Ahmedabad’s decision (OA No 405/2014) to Board. In this regard, it is submitted that efforts may be made to get reply/directions from the Board. Still, even in case of non-receipt of any reply/directions from the Board, the said DPC may be held looking to the following facts-
1.  The CAT, Ahmedabad’s decision (OA No 405/2014) is nothing but directions to follow Hon’ble Apex Court’s judgement in case of N R Parmar and the Board has already taken a stand to follow N R Parmar’s judgement in terms of OM No A-32022/06/2014-Ad.IIIA dtd 8th September,2014. Hence the referring the CAT, Ahmedabad’s decision (OA No 405/2014) to Board has no significance except academic one .
2.  Several other zones have held DPC & issued promotion orders from the cadre of Inspector to Cadre of Superintendent even after delivering of CAT, Ahmedabad’s decision (OA No 405/2014). Copy of one such latest order issued by Delhi Zone  is enclosed for ready reference.
3.  Otherwise also, three months provided under the said CAT, Ahmedabad’s decision for revising seniority list is already over  & the issue is already settled vide Board’s OM No A-32022/06/2014-Ad.IIIA dtd 8th September,2014, DPC can very well be held now without waiting any directions from the Board.
4.   Without prejudice to the above, it is submitted that even if the CAT, Ahmedabad’s decision (OA No 405/2014) is taken into cognizance & Board’s directions are not received,  the DPC for opening of sealed cover may be conducted without waiting for any directions from the Board. Therefore as a first step towards justice to very senior Inspectors, DPC for opening of  sealed covers may be held. 
                In view of the above submissions, without prejudice to our submissions made vide our letter of even number dated 06.04.2016, it is requested in the interest of justice that DPC for promotion from the cadre of Inspector to Cadre of Superintendent may be held on top priority basis, preferably in this month itself.

Subject : Review of Transfer/Posting/Rotation for Group-B Executive Officers of Vadodara Zone – regarding.

            Kindly refer to your office letter No. II/03-22/CCO/2015 dated 05.04.2016 on the captioned matter.

2.         In this connection, All India Central Excise Inspector’s Association, Surat would like to submit the following comments/points for your kind consideration for review purpose of the aforesaid policy and incorporation/amendment accordingly :

(i) In the said policy, there is a provision of normal tenure of a cluster for nine years and three years in a Commissionerate. It is however submitted that the due list issued by the department mentions names of only such officers who have completed nine years in a Cluster. Names of the officers, who have completed 3 years in a Commissionerate and are due for Commissionerate change may also be published. Nine years term for cluster change and three years term for Commissionerate change must be complied without exception.
(ii) Para 5.3 providing for continuous 2 years non-sensitive charge in respect of on request transfer should be implemented strictly without any exemption or relaxation.
(iii) As per Para 7.1, the officers who have completed 6 years in other 2 Commissionerates of the Cluster, may be considered for posting to Audit Commissionerate.
(iv) Postings to Customs zone should be made only through the available pool of the officers as per existing provisions of the policy and no direct recruit be posted in Customs at his first posting. Only seniority wise posting to Customs may be adhered to since there are many officers who are left untouched being neither the senior-most nor the junior-most during the relevant time for several years.
(v) There is no tracking of the officers who have exceeded their maximum tenure in DRI, Surat such as Sh. Bharat Kumar Patel, Inspector (S.List No. 641) was deputed to DRI Surat on 06.05.2010 for five years and has exceeded his tenure by around one year, whereas application for deputation to DRI Surat of Sh. M.S. Prabhat, Inspector is pending for more than one and half years. It is requested that officers may be repatriated from deputation immediately on completion of their maximum tenure and officers with clean track records may be given opportunity to serve in such agencies.
(vi) It is requested to provide separate consideration to the cases of physically challenged persons and providing them exemption from Para 5.3 of the policy as per DOPT OM No. 36035/3/2013-Estt.(Res) dated 31.03.2015, wherein it has been specifically mentioned at Para H that “ the practice of considering choice of place of posting in case of persons with disabilities may be continued. To the extent feasible, they may be retained the same job, where their services could be optimally utilised.”
(vii) The discretionary powers with regard to deviation from the policy provided in Para 19 may kindly be scrapped off to maintain fairness and transparency.

3.         It is requested to kindly update minutes of meeting on CCO, Vadodara website and revise/implement transfer/posting policy accordingly.
